The Alabama Supreme Court recently made a dangerous and arbitrary court decision in the case of LePage v Mobile Infirmary Clinic. This misguided and perilous decision puts reproductive rights and medical practices in the state of Alabama in danger.

The court’s decision equates fertilized frozen eggs (embryos) in fertility clinic freezers to be legally extended to be recognized as children. The decision shows an unmistaken disconnect from medical reality and common sense.

Cryopreservation, a vital aspect of modern fertility care, involving the freezing fertilized eggs or embryos to help patients achieve successful pregnancies. One example of the many patients that depend on freezing eggs and embryos are those surviving cancer. Patients look forward and depend on this procedure to provide them hope for the future after treatment. However, the court’s ruling threatens to restrict access to advanced fertility treatments in Alabama, and fertility specialists and healthcare providers fear legal repercussions.

This arbitrary and capricious act toward residents of Alabama restricts crucial family-building options and deters young physicians from practicing in the state. The Alabama Supreme Court decision undermines the fundamental right to build a family and sets a dangerous precedent of judicial interference with national implications.There is a call for Alabama’s elected officials to safeguard citizens from such judicial overreach and ensure access to quality healthcare remains intact. INCIID is appalled at this decision. We urge you to contact your political representatives in the state of Alabama and also at the federal level in the House of Representatives and the United States Senate.
